By accessing this website, its associated applications, platform, and/or services, you acknowledge that you are over the age of 18 and have read, understood, and agree to be legally bound by the terms set forth herein. If you do not or cannot agree with any part of this Consent to Telehealth, you may not access or use the website, applications, platform, or services.

Introduction

Healthy Path Rx (collectively, “we,” “our,” “us,” or “Healthy Path Rx”) offers a website and related application through which users (collectively, “you” or “your”) may request and obtain online consultations with affiliated, independent, licensed physicians, nurse practitioners, and other provider types (collectively, “Provider” or “Providers”) as managed by our contracted provider network, Architek Health Provider Network, P.C. (“Medical Group”). Services may include consultations, treatment plans, at-home labs, diagnoses, or prescriptions through local and/or mail-order pharmacies partnered with Healthy Path Rx (collectively, “Services”). These Services are provided online via telehealth, which may use synchronous video or voice, asynchronous chat, text (SMS), email, patient portal messaging, or other secure communication methods. Telehealth may involve the electronic transmission of personal health information such as health records, laboratory findings, photographs, video recordings, or information obtained from remote monitoring devices for clinical assessment, diagnosis, treatment, and follow-up.

Potential Benefits of Telehealth

The potential benefits of telehealth include:

  • Access to medical care and health education without leaving home.
  • Private diagnosis and treatment at times more convenient to your schedule.
  • Potentially improved clinical outcomes and more affordable care.
  • Continuity of care with electronic access to providers, prescriptions, and follow-up.

Potential Limitations of Telehealth

Telehealth may involve certain risks, including but not limited to:

  • Technical failures disrupting or distorting treatment information.
  • Sessions being interrupted or accessed by unauthorized persons.
  • Miscommunication between you and your Provider.
  • Information being overheard by others near you.
  • Electronic communication being intercepted, forwarded, or altered without your knowledge.

Additionally, regulatory requirements in your state, your medical history, medication interactions, or your presenting condition may limit your ability to obtain certain Services or prescriptions. Telehealth may not provide sufficient information for an accurate diagnosis or treatment in all cases, and technology failures may disrupt Services. Providers may require in-person evaluation, testing, or follow-up.

Responsibility to Maintain a Primary Care Provider

You are encouraged to consult your local primary care provider and other specialists as needed. Providers through our platform do not replace your local primary care physician or specialists. Maintaining a relationship with a primary care physician is recommended for comprehensive care.

In a medical emergency, you must call 911 or go to the nearest hospital.

No Guarantee of Results

There is no guarantee that using Healthy Path Rx Services or products will result in positive outcomes. Discuss alternative treatment options with your primary care physician or a qualified specialist before and during treatment. You must notify Providers promptly of any adverse effects or unexpected physical, mental, or emotional responses to treatment.

Notification of Changes

You agree to promptly notify Providers of any changes that may affect eligibility for Services, including pregnancy, breastfeeding, recent surgeries, or new diagnoses or medications. You are responsible for disclosing all medications, supplements, allergies, lab tests, and assessments received elsewhere and for notifying other healthcare professionals of any Services or tests obtained through Healthy Path Rx.

Referrals

Some conditions may require in-person care. Providers may refer you to a local medical professional, urgent care, emergency department, or your primary care physician if your condition cannot be treated through telehealth.

Insurance Use and Financial Responsibility

Healthy Path Rx does not accept insurance for Services provided through the platform. You are financially responsible for Services rendered. We do not participate in or accept Medicare, Medicaid, or TRICARE for platform Services. Pharmacy dispensing fees and product costs may be billed separately by the dispensing pharmacy.

Technology & Communications

You may be asked to use specific hardware/software, applications, or connectivity for telehealth. You consent to receive electronic communications, including emails, portal messages, and SMS related to your care and account. Message and data rates may apply. You may opt out of marketing SMS at any time; transactional messages (e.g., appointment reminders, shipping notices) may still be sent as permitted by law.

Privacy & Security; Recording

All confidentiality protections under federal and state law apply to telehealth. Electronic communications may have security risks despite reasonable safeguards. You agree not to record audio or video of encounters without the Provider’s written consent; Providers will not record without your consent unless required or permitted by law.

Prescriptions, Labs & Pharmacy Fulfillment

Prescriptions, if any, are issued only when medically appropriate and lawful based on the Provider’s independent clinical judgment. Certain medications (including controlled substances) may be unavailable or restricted by state law or medical policy. Pharmacies may dispense therapeutically equivalent products or make substitutions as permitted by law. At-home or third-party lab testing has inherent limitations; false positives/negatives may occur and may require confirmatory testing. You authorize the Provider and pharmacy to access prescription drug monitoring program (PDMP) data as required by law.

Informed Use & Off-Label Therapies

Providers may recommend FDA-approved medications, devices, or therapies for uses different from FDA-labeled indications (“off-label”) when supported by clinical judgment. You may refuse any recommended medication or therapy.

State Licensure & Location

Telehealth Services are provided only when the Provider is licensed (or otherwise legally authorized) in the state where you are physically located at the time of the encounter. You agree to truthfully disclose your current location before and during each encounter and to update the Provider if your location changes.

Telehealth Acknowledgment

By accepting this Consent to Telehealth, you affirm that you:

  1. Understand and consent to receive medical care and treatment via telehealth from affiliated Providers.
  2. Have read this Consent carefully and understand that telehealth may provide benefits but has inherent risks, and results cannot be guaranteed.
  3. Understand that all confidentiality protections under federal and state law apply, but certain mandatory or permissive disclosures may occur (e.g., risk of harm, abuse reporting, court orders).
  4. Understand that Providers may employ varying approaches to care, which you have the right to accept or decline.
  5. Understand that Providers may recommend FDA-approved devices or medications for uses different from FDA-labeled indications, which you may refuse.
  6. Understand that affiliated Providers supplement, but do not replace, your primary care provider.
  7. Understand that no guarantee of satisfactory results is provided.
  8. Understand that Providers may determine your condition is inappropriate for telehealth, requiring in-person care.
  9. Understand that telehealth cannot provide urgent or emergent care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency department.
  10. Understand that you have access to your health information in accordance with applicable laws and policies.
  11. Agree to provide accurate and complete health information to Providers and to update that information as it changes.
  12. Consent to Healthy Path Rx, the Medical Group, Providers, and affiliated pharmacies/labs collecting, using, and sharing your information as permitted by law, our Privacy Policy, Business Associate Agreements (as applicable), and Notices of Privacy Practices.
  13. Agree to hold harmless Healthy Path Rx, the Medical Group, Providers, partners, vendors, pharmacies, parent company, agents, and subsidiaries for delays or data compromise resulting from platform technology failure beyond reasonable control.
  14. Understand that consent can be withdrawn at any time in writing by emailing [email protected]. Withdrawal will not affect information already used/disclosed or care already provided. Unless withdrawn, consent renews with each telehealth consultation.

Services from Medical Group

Healthy Path Rx is not a medical group and does not provide medical advice or treatment. Providers accessed through our platform are independent and contracted through Architek Health Provider Network, P.C. Care is the sole responsibility of the Medical Group and its Providers. You agree that any prescriptions obtained from a Provider are for personal use only. You must read all product information and labels and contact your Provider with questions regarding use or side effects.

Use Agreement

By establishing an account and/or logging onto Healthy Path Rx’s website, applications, or platform, and by using any Services, you acknowledge and accept the most current version of this Consent to Telehealth. Updates will be posted on the website and supersede prior versions. You are encouraged to review this Consent, the Terms & Conditions, and the Privacy Policy regularly.

Telemedicine services through this website and platform are provided by independent medical Providers, including Architek Health Provider Network, P.C., and their affiliated Providers. Lead Physician Dr. Alex Jabourian and affiliate Providers practice in accordance with applicable state licensure.
